General Terms and Conditions (GTC)
ATI – Aero Technical Investigations Expert
Expert in Aviation Technology and Accident Analysis
1. Scope of Application
These General Terms and Conditions apply to all services provided by: ATI – Aero Technical Investigations Expert in Aviation Technology and Accident Analysis towards clients from the private, commercial, or public sector. Deviating conditions of the client shall only apply if they have been explicitly agreed upon in writing.
2. Subject of Performance
The contractor performs independent technical investigations, expert assessments, and reports in the field of aviation technology and accident analysis. The services are provided to the best of knowledge and belief and in consideration of the recognized technical standards at the time of service provision.
3. Conclusion of Contract
A contract is concluded through written commissioning, acceptance of an offer, or confirmation of the order. The scope of services results from the respective agreement or the offer.
4. Independence of the Expert
The expert provides his services independently, impartially, factually, and professionally objectively. A specific result is not owed.
5. Duties of Cooperation of the Client
The client commits to:
• provide all necessary information and documents completely
• enable access to relevant objects or documentation (including third parties)
• immediately inform of relevant changes/circumstances. Delays due to lack of cooperation are not
the responsibility of the contractor. 6. Compensation The compensation is made in accordance with individual agreement, offer, or written arrangement. Additional costs that exceed the agreed scope of services will be charged separately.
7. Dates and Deadlines
Information on processing times is non-binding unless expressly agreed in writing as binding.
8. Liability
The contractor is liable for damages only in cases of intent or gross negligence. No liability is accepted for indirect damages, consequential damages, or lost profits, as far as permitted by law.
9. Use of Expert Reports
Reports, statements, and documents are intended solely for the agreed purpose. Any disclosure or publication, even in extracts, requires the consent of the contractor.
10. Confidentiality
All information received in the context of collaboration will be treated confidentially, unless there are legal disclosure obligations.
11. Copyright
All documents, reports, and analyses created are subject to the copyright of the contractor.
12. Final Provisions
The law of the Federal Republic of Germany applies. If individual provisions are ineffective, the effectiveness of the remaining regulations remains unaffected.
